Welcome to CacheGenie ("we," "us," or "our"). By accessing or using our services, you agree to comply with and be bound by these Terms of Service ("ToS"). If you do not agree to these ToS, please do not use our services.

Service Description

CacheGenie is a content delivery network (CDN) and DNS provider. Our services are subject to these ToS, and any additional terms or policies provided by us.

Privacy & Data Policy

Your use of CacheGenie services is also governed by our Privacy & Data Policy, which outlines how we handle your data. By using our services, you acknowledge and accept our Privacy & Data Policy.

Pricing and Billing

CacheGenie's service pricing may change at our discretion. We reserve the right to update pricing information without prior notice. CacheGenie operates on a credit-based billing system. Users are required to maintain a credit balance in their accounts to use our services. Invoices for the previous month's usage will be generated on the first day of each month, and charges will be deducted from the user's account balance.

Users are responsible for ensuring that their account maintains a credit balance (or remains neutral) at all times. To add credits to your account, you can make payments using the provided card payment gateway.

Users may request a refund of their remaining account balance (excluding any free credits) at any time. However, it's important to note that refunds will not take the user's account balance into a negative state, nor will they exceed the amount owed in pending charges.

If a refund is requested, we will process it promptly in accordance with this refund policy. Refunds will only be issued to the original payment method used to add credits to the account.

Account Termination

We may terminate your account and restrict access to our services without prior notice for reasons including, but not limited to, violations of these ToS, requests by law enforcement, or provision of false information. We are not liable for any resulting disruption or damages.

Content Hosting

CacheGenie may make and store copies of your content to distribute it on our network. You retain ownership and intellectual property rights to your content. By using our services, you grant us permission to maintain and distribute these copies.

Service Level Agreement (SLA)

We strive to provide 24/7 service availability with a target of at least 99.99% monthly uptime for our content delivery service. However, occasional unavailability may occur, and we do not guarantee uninterrupted service. For more information, please refer to our dedicated SLA Policy below.

Limitation of Liability

To the extent permitted by applicable law, CacheGenie, its affiliates, directors, and employees are not liable for any damages, including loss of profits, business interruption, or data loss, arising from the use of our services.

DMCA and Copyright Compliance

Copyright Abuse - CacheGenie does not tolerate copyright abuse or misuse of our services for distributing copyrighted content without proper authorization. If you believe that someone is abusing our services to infringe copyrights or if you have any other copyright-related concerns, please report it to us by contacting our support team using the details provided below.

CacheGenie is committed to respecting copyright and intellectual property rights. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) and strive to promptly address any copyright infringement claims. If you believe your copyrighted work has been used or distributed through CacheGenie's services without proper authorization, please follow the procedures outlined below:

  1. Submit a written notice to our designated DMCA Agent (contact details provided below), including the following information:
    1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
    2. Identification of the copyrighted work that you claim has been infringed.
    3. Identification of the material that is claimed to be infringing and its location on CacheGenie's services.
    4. Information reasonably sufficient to permit CacheGenie to contact you, such as your address, telephone number, and email address.
    5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
    6. A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.
  2. Once we receive a valid DMCA takedown notice, we will promptly investigate and take appropriate action, which may include removing or disabling access to the allegedly infringing material.
  3. If your content is removed due to a DMCA notice, you may submit a counter-notification in accordance with the DMCA. The counter-notification must include your contact information, a statement under penalty of perjury that you have a good faith belief that the material was removed in error, and your consent to the jurisdiction of a federal court where your address is located.

Service Level Agreement (SLA)

Uptime Guarantee

CacheGenie guarantees a monthly uptime of 99.99% for its CDN and DNS services.

DDoS Protection

CacheGenie provides DDoS protection to safeguard customer services against malicious attacks.

Data Privacy

CacheGenie adheres to strict data privacy and protection standards in compliance with applicable laws.

SLA Outage Credits

In the event of monthly availability falling below our guarantees, your account will be eligible for SLA credits based on your monthly usage. These credits serve as compensation for service disruptions that do not meet our promised uptime levels.

SLA Credits are issued upon request and are handled on a case-by-case basis. The amount of compensation and the eligibility criteria will be determined by CacheGenie, taking into consideration the nature and duration of the outage, as well as its impact on your services.

To request SLA Credits, please contact our support team within 30 days of the outage event. We will review your request promptly and work towards a fair and reasonable resolution.

Acceptable Use Policy

This Acceptable Use Policy outlines the terms and conditions governing the use of our services. By using CacheGenie's services, you agree to comply with this Policy.

General Agreement

All CacheGenie services must be used for lawful purposes. You agree not to engage in any activity that violates applicable laws, regulations, or third-party rights, including but not limited to:

  • Transmission or storage of copyrighted, trademarked, or proprietary material without proper authorization.
  • Dissemination of content that is defamatory, obscene, constitutes an illegal threat, or violates export control laws.

Abuse of Our Service(s)

CacheGenie is committed to maintaining the quality of its services. Any actions intended to abuse, disrupt, or harm our services or infrastructure may result in the immediate termination of your account without a refund. If you suspect any abuse or system/network security issues, please report them to Protected Email.

Copyright Infringement & Illegal Content

CacheGenie does not actively monitor user content, but you are solely responsible for the content you distribute through our services. CacheGenie will cooperate with authorities investigating illegal activities, including copyright infringement, as required by law.

Adult Content

CacheGenie permits the use of its services for "adult content" providers, provided that the content complies with the laws of the United Kingdom (the country we are registered in), the country for which you reside, and the CacheGenie Terms of Service.

Illegal Use

Examples of illegal use include the distribution of spyware, adware, spam, scams, illegal content, hate speech, child pornography, or any other content that violates societal norms. CacheGenie reserves the right to disable accounts found in violation of this policy without a refund, depending on the severity of the violation.
